Resolution 2012-3: Procedures for Receiving and Reviewing Complaints

 

Effective: September 12, 2012

The Virginia Department of Professional and Occupational Regulation (DPOR) has established the office of Common Interest Community Ombudsman. The Ombudsman hears complaints of alleged violations by Association Boards of Directors of common interest community laws or regulations.

Talltree South has established its process for filing complaints against the board with the management company, Cardinal Management, who will review the complaint and follow the procedure to address the complaint and potentially escalate it to the Ombudsman if appropriate.

Note that these types of complaints are NOT ordinary complaints about a light being out, a water leak, or a car being accidentally towed, but serious complaints that the Association or the Board has broken the law. For routine complaints, please continue to fill out an Action Request Form and provide it to the Site Office. Contact the Site Office for assistance.

Water Leaks

It is important that every owner maintain his or her unit so that it does not leak, but sometimes accidents occur such as overflowing tubs, leaking pipes, or showers with failing caulk or grout. If a leak originates in a unit, it is the responsibility of that unit owner to fix the problem and any damage caused to other units or to the common elements. If a leak originates in a common element, it is the Association's responsibility.
